Silk and construction checks
Fabric
Genuine carrés use silk twill. Copies often use charmeuse, polyester, or silk blends. Fiber content needs a lab test or a burn test to confirm. Photos do not prove fiber content.
Hem
Genuine scarves have hand-rolled, hand-stitched hems. Machine-rolled hems with a straight stitch line are the most common tell on copies.
Hermès screen-prints each design with a large number of color screens. Copies use digital printing in most cases. Digital prints show soft edges and dot patterns under a 10x loupe.
Labels and codes
Genuine items carry a woven label, a blind stamp, and a date code. Copy labels often use the wrong font weight or place the stamp in the wrong corner.
Legal status in the United States
The Lanham Act covers trademark counterfeiting. 15 U.S.C. § 1117(c) allows statutory damages up to $2,000,000 per counterfeit mark per type of goods for willful use. US Customs and Border Protection can seize and destroy counterfeit shipments. Counterfeit goods are not covered by the personal-use exemption that applies to some other trademarked items.
